Fourth post in the Internet and trade-mark law series. We're about half way through and this is where is gets "interesting". So interesting in fact that I'm posting this on a Saturday evening.

Software / music / hardware / platform / everything… as a service

 

In addition to the problems discussed in previous updates, let us consider the “as a service” trend which in our view is another disruptive concept for trade-mark law.

 

The line between wares and services is not a clear cut. Consider music. Before the invention of sound recording equipment, music was a service. Had Mozart filed a trade-mark application, he would probably have defined its “product” as a service, namely the service of “composing music masterpieces”. Along the same line, a famous orchestra would have defined its services as “public performance of music masterpieces”.

 

In the 20st century appeared the music industry. You could sell music, in the form of records, cassettes and CD’s for people to listen in their home. Music was still a service (there was still live music shows and music still played on the radio), but the biggest share of the revenues came from the sale of physical goods containing music. Hence the Platinum, Gold and other sales recognition awards.

The real definition of Journeyman is..

Ok, lets get accurate about the definition of a Journeyman trades person. The State of California definition is exactly:
“A journeyman is a person who has completed an apprenticeship program or is an experienced worker, not a trainee, and is fully qualified and able to perform the trade without supervision.”
The four years of Journeyman experience is only one requirement necessary p...State of California contractors licensing exam. A homeowner who has construction experience may also be journeyman skilled.
I run a new trade school in California and train people to the journeyman level to work as independent contractors. I would be happy to try and answer any questions you or others have about working in the trades.
