What is Copyright and not?

What is Copyright and not?

A sentence on the BBC news website in an article about patent applications for graphene (which has since been amended) stood out yesterday morning; it stated that there has been “a sharp rise in patents filed to claim copyright over different aspects of graphene”. We couldn’t comment about the other jurisdictions mentioned in the article, but in the UK, copyright and patents are different types of IP and it is not possible to patent copyright in itself and claiming copyright is different to patenting an invention. In view of this, the Technology Law Update team thought it would…

Definition of Copyright under Act

This post is excerpted from the upcoming e-treatise “Wassom on Social Media Law.” Copyright exists in order “to promote the Progress of Science and useful Arts.” It accomplishes this by giving authors an economic incentive to create new works and share them with the public.  But private control over the use of expressive works doesn’t always promote progress; indeed, giving copyright owners too much control over the works they’ve created not only impedes societal progress, but also creates tension with the fundamental principles of free speech and the exchange of ideas that…

Turnitin, the global leader in originality checking and online grading, today announced a website evaluation rubric to teach students how to analyze and grade the academic quality of the Internet sources used in their writing. The development of The Source Educational Evaluation Rubric (SEER) is in response to recent studies finding that students over-rely on Internet-based sources with questionable academic value. Turnitin worked closely with educators to design SEER, which is built on five criteria: Authority, Educational Value, Intent, Originality, and Quality. SEER was field…

What is Patent Term extension?

By Dennis Crouch Exelixis v. Kappos (Exelixis II) (E.D. Va. 2013) We now have a district court split on post-RCE patent term adjustment. This decision – siding with the PTO – arises from a second Exelixis case and will be called Exelixis II (Brinkema, J.) In Exelixis I, Judge T.S. Ellis sided with the patentee in finding that the PTO was improperly under-calculating the patent term owed to patentees who had filed a request-for-continued examination during the course of prosecution. Exelixis v. Kappos, — F. Supp. 2d —, 2012 WL 5398876 (E.D. Va. Nov. 1, 2012), as amended Nov…

Management and Evaluation of Patent Trademark

I think it is about time the U.S. adopts a small claims proceeding so that patent owners have a meaningful mechanism to seek redress for smaller cases of infringement. Patent owners faced with one or more infringers in the marketplace can experience very real and damaging effects when the dollars involved are measured in the tens of thousands. But under the current patent infringement resolution mechanisms it frequently doesn’t make sense to pursue infringement from a financial standpoint even when infringement is measure in hundreds of thousands of dollars. Indeed, very real…

On July 10, 2012, the Center for American Progress issued a report titled “Do Schools Challenge Our Students: What Student Surveys Tell Us About the State of Education in the United States, ” by Ulrich Boser and Lindsay Rosenthal.  Utilizing feedback from students, it summarized student perceptions of their experience.  In state after state, at different age levels and for different subjects, a third to a half of students echoed a familiar theme: “too easy, ” “little reading, ” “almost never write.” They don’t write about what they read, don’t summarize, don’t identify main…

Evaluation of trade Mark

Evaluation of trade Mark

Still, it seems a little reckless to me to select a trademark that incorporates ARMOR or ARMOUR when entering an industry that has a heavyweight such as Under Armour with a large trademark portfolio and the means to enforce that portfolio. Is the name BODYARMOR so critical to the success of the company and selling their drinks? I doubt it. So then why run the risk of incurring the wrath of a well funded and well known trademark owner? It just doesn t make business sense if you ask me. That is why I always advise companies to consider doing a rather exhaustive trademark search…
