MANILA, Philippines — Filipinos living and/or working abroad can bring home more copies of books, compact discs, and digital video discs under a new copyright law that was approved last December.

The Philippines’ intellectual property body made this clarification on Friday, a day after journalist-blogger Raissa Robles wrote that the new Intellectual Property Code or Republic Act 8293 would impair Filipinos rights to bring in imported books and optical media.

“Contrary to Ms. Robles’ insinuations that OFWs [overseas Filipino workers] can no longer bring home copyrighted works, they can in fact bring home more copies for personal use that fall under the fair use exceptions, ” the Intellectual Property Office of the Philippines (IPOPHL) said.

On its website, the agency also answered the points raised by journalist Raissa Robles in her blog post entitled “Congress erased every Filipino’s right to bring home music, movies and books from abroad.”

Robles claimed that the revisions to RA 8293 would remove the right of Filipinos to bring home books, CDs, and DVDs purchased abroad. Robles cited the absence of the existing law’s Section 190.1—“which specifically guaranteed the rights of ordinary Filipinos flying home from overseas to bring home copyright materials such as DVD movies, music CDs and books” — in the proposed amended version.
