WIPO What is Intellectual Property

WIPO What is Intellectual Property

South-East Asia is host to one-third of the world’s 39 million blind people. Over 20 million live in India alone. This week’s special session of the World Intellectual Property Organization aims to clean up the text of an international treaty to facilitate access to books for the blind and visually impaired community. It is thus of prime importance for India, and some there worry that issues such as commercial availability could undermine the treaty’s effectiveness. What is trademarking?

What is trademarking?

What is USE IN COMMERCE for the purposes of U.S. trademark registration? In order to have your trademark registered in the U.S.A., you have to be using your trademark in U.S. commerce, and be able to prove the same. A common question asked by clients is exactly what constitutes “use in commerce”?   Use in commerce means the bona fide use of a mark in the ordinary course of trade, and not made merely to reserve a right in a mark.  A mark is considered to be in use in commerce:  1. On goods when it is placed in any manner on the goods or their containers or the displays associated…

What is Trade Marketing Services?

Business-to-business media and information companies have always prided themselves on their market expertise to the point of being able to do what their readers do. The industry is filled with stories of editors becoming certified in the disciplines they cover (from farming to firefighting to hair dressing –Alison Shipley, editor of Vance’s salon trade publication First Chair, attended beauty school five nights a week from 4:30 to 10pm to obtain her certification ). The same applies to the marketing side — particularly in an industry where many advertiser-media partner relationships…

What is the definition of patent?

By Carl Nuzman, Alcatel-Lucent Bell Labs At the end of last year, my fellow inventor Gerhard Kramer (who is now working at the Technical University in Munich, Germany) and I were honored with an Edison Patent Award from the Research and Development Council of New Jersey – for a recent patent in the VDSL2 Vectoring space. For me, this award recognizes the pioneering work of our entire Vectoring team, and highlights how much we’ve enjoyed helping to bring this exciting technology from imagination to reality. Until recently, there was an expectation that the only way to meet the…

What is the definition of Organizational Learning?

What is the definition of Organizational Learning?

Theories of learning seem to be just as vast as theories of personality, and just as (if not more) controversial. I could spend many months (probably years) studying this topic! So, this post will just scratch the surface of the most prominent pedagogical learning theories (theories about how children learn), and relate them to adult learning practices in the workplace. I’ll start by answering the question, “What is learning? ” and then will review four major learning theories–behaviorism, cognitivism, social cognitive theory, and constructivism. Future posts will cover additional learning…

What is the definition of copyright violation?

Advocates are praising a newly revised version of New York’s “Rape is Rape” bill that classifies any vaginal contact as “rape, ” bringing the legal definition of that form of sexual assault in line with the standards for forced anal and oral contact. The change came shortly after Gov. Andrew Cuomo (D) endorsed the bill on Tuesday, when Republican state Sen. Catharine Young (pictured) introduced a second version that removes the legal requirement of “penetration” for forced vaginal penetration to be considered “rape, ” and expands the conduct covered by the term to include forced…

What is the Definition of Copyright Laws?

As promised in the comments section of my last post, I offer in this post the outline of my proposal to effectively combat revenge porn. A few preliminary notes: one, this is very much a work in progress as well as being my first foray into drafting legislative language of any kind. Two, a note about terminology: while “revenge porn” is an attention-grabbing term, it is imprecise and potentially misleading. The best I have come up with as a replacement is “non-consensual pornography, ” so that is the term I will use throughout this post. I would be interested to hear suggestions…

As a key platform for the delivery of online information and content, databases have become valuable business assets. They represent an investment of time, money and skill, meaning that protecting your database from others is important due to its commercial value. Electronic databases can be described as “a collection of independent works, data or other materials which are arranged in a systematic or methodical way and are individually accessible by electronic or other means”. Thereintellectual property is protected; Rollingsons has experienced lawyers who can advise you about…

Do you find the Apple iPad just a little too expensive? With prices for the third-generation iPad starting around $500, there s still lots of room in the tablet market for budget-priced slate devices. Over the past year that gap has been partly filled with the release of Google s Nexus 7 device and Apple s own iPad Mini. But French consumer electronics company Archos believes there s still lots of room for low-cost slates. Archos Unveils Line of Tablet Devices That s why the company has unveiled three new devices which together comprise a new Platinum line of tablet computers…

What is software Code Quality?

What is software Code Quality?

Once upon a time there was a triangle. It was the traditional project management “iron triangle” of cost, time and quality. (Sometimes time is replaced by scope.) The principle we learned was “you can fix any two, but it will affect the other”. The fact that it wasn’t entirely flexible gave rise to the “iron” element. But in my own experience life was never that simple. Oddly, if I tried to sacrifice code quality on a project then we would still spend much unplanned time (i.e. long nights) fixing bugs. In recent years the software movements around agile and lean have taken code…

What is patents in Balance sheet?

By Kofi Bofah: On Jan. 30, Research In Motion brought its latest BlackBerry 10 operating system to market. Wall Street, however, was not very impressed as the stock immediately collapsed by 12% to close out the trading session at $13.78. That very same day, Research In Motion executives announced that the company was set to officially rename itself BlackBerry (BBRY). In conjunction with this move, the corporation formerly known as Research In Motion awarded R&B entertainer Alicia Keys the title of "global creative director." Taken together, these recent…

What is patentable product?

This spring, the Supreme Court will take on the issue of gene patenting in Association for Molecular Pathology v. Myriad Genetics. Today, over 40, patents are currently held on roughly 20 percent of all human genes. Cardozo Professor Daniel Ravicher is co-counsel with the American Civil Liberties Union (ACLU), who is arguing that genes are products of nature and should not be patented. The Supreme Court will rule on the question of whether isolated genes are “products of nature” that are not eligible for patent protection, or if they are “human-made inventions” that may be…

What is patent Trademark and Copyright?

Everyone has a great idea.  Maybe you are a first time inventor who came up with an idea for a new and useful product, process or methodology.  Maybe you are a seasoned business person, and you created a brand name.  You have developed a successful market for your brand, and now you want to protect your brand name and logo.  Maybe you are an entrepreneur, you are about to embark on a business venture, and you came up with an idea for a catchy slogan to market your new products or services.  Or maybe you are a creative writer, a music artist, a filmmaker, or a fashion designer…
