After a jury awarded the plaintiff $60 million for copyright infringement and just over $51 million for patent infringement, the defendant appealed both verdicts, claiming they lacked sufficient evidence.

In particular, the defendant argued that the standard of copyright damages mirrors that of patent law, i.e., that the plaintiff had to prove its copyrighted features drove consumer demand for the infringing product. But that overstated the standard, the court held. The plaintiff must only establish causation, i.e., that “but for” the infringement, the defendant wouldn’t have made its gross sales. “The burden then shifts to [the defendant] to apportion that gross revenue between profit and expenses and among infringing and non-infringing features of the product.”

Rather than apportion the profits, however, the defendant’s expert said it was only obligated to pay the amount saved by copying the plaintiff’s copyrighted information, instead of generating it on its own, which amounted to no more than $6, 000. In response, the court found the plaintiff didn’t have to offer an expert to apportion damages—but it was a good thing it did, because his rebuttal testimony showed the defendant made $93 million in net profits, sufficient to support the jury’s $60 million award.

We need domestic and international economic vision that everyone can understand and refine and make their own. We need it to generate hope, to provide inspiration, to reveal what is possible and valuable, and to orient and also democratize our strategies so that they might take us where we desire rather than in circles or even toward something worse than what we now endure.

Enron could not have done better if it had organised the publicity campaign itself. For six years in a row Fortune magazine named it the most innovative corporation and only last August listed the firm as one of the ten growth stocks to last the decade. As recently as last year, the Economist in Britain praised Enron for having created what might be the “most successful Internet venture of any c...ce of working people, the producers of all wealth, is subordinated to the ever-more frenzied process of profit accumulation for the benefit of the few. That situation must be reversed. That is, society must be re-organised so that the mode of accumulation of wealth is subordinated to the needs and requirements of its producers and is controlled and regulated by them. Teresa Heinz Kerry, through a network of investments in blue-chip corporations, venture capital funds and municipal bonds, controls a family fortune worth an estimated $1 billion, an examination of public records shows.
The $1-billion figure is double the estimates of her recent months for interviews. Campaign representatives for Sen. Kerry and his wife said the couple regarded their assets as private. The representatives also declined to provide answers to written questions over the last two weeks.
Heinz Kerry's money is actively managed every day of the year, providing capital to Gannett, Anheuser-Busch, Pfizer and Procter & Gamble, among many others.
