The following scenarios are fictitious yet realistic examples from the lives of educators…

  1. Mrs. Rhyme would like her 2nd grade class to read poems from Shel Silverstein’s Where the Sidewalk Ends. She decides to copy a packet of 5 of her favorite poems and hand them out to the entire class. Each poem has an average of 100 words. The book is a collection of over 75 poems. Does this action hold to the copyright laws?
    Yes, Mrs. Rhyme is copying poems that are less than 250 words a piece, and is copying less than 10% of the book. This falls under the Brevity Test.
  2. Mr. Hollywood has recently recorded an educational program off of PBS for his students. One evening, he turns on the television to find that his favorite movie, Wedding Crashers, is on HBO. He jumps up to record it and decides that this will be the weekend movie choice with “the guys”. Does this action hold to copyright laws?
    No, Mr. Hollywood can legally record an educational program but the material can only be shown once by the teacher during the first 10 days after taping and may be repeated only once for purposes of instructional reinforcement. After 45 days the tape must be erased or destroyed. The PBS program is legal as long has he remains within these boundaries. However, The Wedding Crashers is not an educational program, and therefore would not fall under the fair use doctrine of “for educational purposes”. (Uden, Dr. Michael. Comp. Education.
